Artificial Intelligence Study


The U.S. Copyright Office is conducting a study regarding the copyright issues raised by artificial intelligence (AI). This study will collect information and policy views relevant to copyright law and policy. The Office will use this information to analyze the current state of the law, identify unresolved issues, and evaluate potential areas for congressional action.


The Office published a notice of inquiry on August 20, 2023, with a deadline for initial written comments on October 30, 2023, and reply comments on December 6, 2023. The Office received over 10,000 comments by the December 2023 deadline. Initial and reply comments have been posted and are available through regulations.gov. The Office is issuing a Report in three Parts analyzing the issues, are being published as they are completed.


On July 31, 2024, the Office published Part 1 of the Report, which addresses the topic of digital replicas. On January 29, 2025, the Office published Part 2 of the Report, which addresses the copyrightability of outputs created using generative AI. On May 9, 2025, the Office released a pre-publication version of Part 3 in response to congressional inquiries and expressions of interest from stakeholders. A final version of Part 3 will be published in the near future, without any substantive changes expected in the analysis or conclusions.
