Copyright Office Issues Interim Rule on Secure Tests Affected by COVID-19

The Copyright Office has published an interim rule that continues its existing interim rule addressing eligibility for its special registration procedure for “secure tests.” During the COVID-19 emergency, certain tests normally administered at specified centers were temporarily being administered remotely. The Office’s May 2020 interim rule provided that such tests remain eligible for registration as secure tests, provided the administrator employed security measures that are at least equivalent to in-person proctoring. This previous interim rule expired when the national emergency ended. However, the Office has decided to continue that rule while it determines whether, and in what circumstances, it should allow remote testing to be eligible for secure test examination.
