U.S. Copyright Office Issues Final Rule Encouraging Electronic Delivery of Section 411 and 508 Litigation Notices

The U.S. Copyright Office has published a final rule in the Federal Register permitting the use of email to provide notice to the Office regarding the filing of a copyright infringement lawsuit or a request to the Register of Copyrights to opine on registration issues. Previously, the notices required under sections 411 and 508 of the Copyright Act were submitted to the Office by mail, which risked delays and caused unnecessary burdens for both submitters and the Office. The new rule, developed in consultation with the Administrative Office of the U.S. Courts, will alleviate these issues by requiring notice to be sent to the Office via email to specially designated email addresses.
