OFFICE ANNOUNCES INTERIM REGULATIONS ON NOTICE AND RECORDKEEPING REQUIREMENTS FOR USE OF SOUND RECORDINGS
The Copyright Office is announcing interim regulations specifying notice and recordkeeping requirements for use of sound recordings under section 114 and section 112 of the Copyright Act. These interim regulations set forth the requirements for an eligible digital audio service to file notification that it is using one or both of the statutory licenses and the types and details of information that the service must maintain in creating a record of use for the performances of copyrighted sound recording it provides to its listeners. These regulations are effective beginning April 12 and apply only to the use of sound recordings from that date prospectively. For further information, click here.
OFFICE PROPOSES TO AMEND REGULATIONS GOVERNING CONTENT AND SERVICE OF CERTAIN NOTICES ON COPYRIGHT OWNER OF A MUSICAL WORK
The Copyright Office is proposing to amend its regulations governing service of notice to use the section 115 license and filing of such notice with Copyright Office. The notice is served or filed by a person who intends to use a musical work to make and distribute phonorecords, including by means of digital phonorecord deliveries, under a compulsory license.
